1. Acceptance
By using Andante AI ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms form a binding agreement between you and Nicomotica ("we", "us"). If you are using the App through Apple's App Store, Apple's standard End User License Agreement (EULA) also applies, and these Terms are concluded between you and Nicomotica only — Apple is not a party.
2. Description
Andante AI is an iOS travel companion that uses AI to help you plan, replan, and remember a trip. The App reacts to weather, location, mood, and bookings to adapt your itinerary in real time. Some features are gated behind paid tiers (see Section 8).
3. Eligibility & Age
You must be at least 13 years old to use the App. Users between 13 and 17 may only use the App with the consent of a parent or legal guardian. The App is not intended for, and we do not knowingly collect data from, children under 13.
4. User Accounts & Account Deletion
You sign in through Sign in with Apple, Sign in with Google, or email + password. You are responsible for maintaining the security of your account credentials.
In-app account deletion. You may delete your account at any time from within the App. Doing so erases or irreversibly anonymizes your trip data, preferences, location pings, AI request cache, and account-level data within 30 days, except where retention is required by law.
Cancelling a paid subscription does not delete your data — your trips become read-only but stay accessible. Subscriptions and Apple-side purchase records are managed by Apple separately.
5. User Content
By submitting trip notes, photos, ratings, or other content ("User Content") to the App, you grant Nicomotica a worldwide, non-exclusive, royalty-free license to host, store, and use your User Content within the App for the purpose of operating the App for you. You retain ownership of your original User Content.
6. AI-Assisted Features
The App includes AI-assisted features such as itinerary planning, in-trip replanning, and post-trip recap generation. These features are delivered by the Andante AI engine — our proprietary orchestration of large language models, run on enterprise inference contracts over secure cloud infrastructure. We do not authorize our inference partners to use your inputs to train general-purpose models. AI output is provided "as is" and may be incomplete or inaccurate — you remain responsible for verifying critical details (booking confirmations, opening hours, prices, visa or health requirements) before relying on them.
7. Acceptable Use
You must not use the App to generate content that is unlawful, harmful, harassing, infringing, or that attempts to manipulate or bypass the App's safety systems or the underlying AI engine. You must not scrape, reverse-engineer, or systematically extract data from the App outside of features explicitly provided.
8. Subscriptions, In-App Purchases & Refunds
Some features require a Trip Pass (one-time) or a Pro subscription (monthly or annual). All payments are processed by Apple. Auto-renewable subscriptions renew at the end of each period unless cancelled at least 24 hours before the end of the current period through your Apple ID Subscriptions settings. Refunds are handled by Apple under the Apple Media Services Terms; we cannot directly issue refunds for App Store purchases.
9. Third-Party Services
The App relies on Apple (Sign In, App Store, Push Notifications, MapKit), Google (Sign In, Places API), and the secure cloud infrastructure that hosts our backend and powers the Andante AI engine. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.
10. Disclaimers
The App and all AI-generated content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or accuracy. We do not warrant that the App will be uninterrupted or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, Nicomotica shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the App. Nicomotica's aggregate liability shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 50.
12. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Chile, without regard to conflict-of-law rules, except where mandatory consumer-protection law of your country of residence provides otherwise. Disputes shall be resolved in the courts of Santiago de Chile, except where applicable law grants you the right to bring action in your local courts.
13. Apple-Specific Terms
If you obtained the App from the Apple App Store, you acknowledge that: (a) these Terms are between you and Nicomotica only, not Apple; (b) Apple has no obligation to provide maintenance or support; (c) Apple is not responsible for addressing claims relating to the App; (d) Apple is a third-party beneficiary of these Terms; (e) you must comply with applicable third-party terms (including the App Store Terms of Service); and (f) you represent you are not located in a U.S.-embargoed country.
14. Changes
We may update these Terms from time to time. Material changes will be communicated through the App or by email where appropriate.
